Podnositelj predstavke žali se na talijanski ekološki porez kojim se navodno diskriminira vlasnike automobila koji onečišćuju okoliš. Tvrdi da bi se taj porez trebao primjenjivati i na druga vozila, a ne samo na rabljena vozila s visokim emisijama koja su uvezena iz drugih država članica EU-a i po prvi put registrirana u Italiji. Smatra da se time narušava sloboda kretanja robe.
