The aim of this petition is to lay out a safe framework for e-scooters on our roads. with this in mind, EU should require countries to abide by an umbrella policy the regulates them properly. below is what I would consider safe and fair regulations. (I own a Taverun Blade X - Minimotors Variant capable of 75kmh, 4Kw across 2 motors, and 48kgs)
Ligher scooters like Xiaomai and Pure (800W< /25kmh< /35kg< ) - Classified as "Light"
- Require helmets with a visor, high-visibility vest
- Maintenance checks and tests every year for brakes, motors and batteries.
- use cycle path (7kmh on a footpath if necessary to mount)
Heavier scooters like Minimotors, Taverun, Kaabo etc. (1,500W< /50kmh< /40kg< ) - Classified as "Heavy"
- Deck-lighting, optional stem lights, tail lights & headlamp and horn
- indicators (on the back at least)
- Insurance, license and Registration (no-sale under 18)
- full face helmet, knee-pads, elbow-pads and High-Visibility Vest
- Maintenance checks and tests every year for brakes, motors and batteries.
- use Roadway and enter normal traffic, use cycle-path if necessary (restrict to 25kmh) and footpath at 7kmh to traverse some intersections. (no motorways)
Super-Heavy like Nami, Dualtron Victor, Taverun/Minimotors Blade X (5Kw< /100kmh< /80kg<) - Classified as "Super-Heavy"
- Deck Lighting, road lighting, tail light, headlamp, indicators (front and back).
- front and rear braking + electric braking/regenerative braking.
- horn (above 75Db) keyed ignition, power control.
- Full Face Helmet (motorway/highway/autobhan grade), full body protection (armored or leather as a motorbike)
- Insurance (full coverage), Tax, License, Registration, no-sale under 18, safety testing every 6 months.
- use roadway, enter traffic and abide by all road laws. No cycle path (except in an emergency) and footpath at 7kmh to traverse intersections only or to make a roadside repair. (No motorways)
Hyper-Scooters (>/=5Kw /~100kmh - 200kmh / ~20kg - 150kg) - Classified as "Sports/Hyper-Scooter"
- Not obliged to any law, but may only be used to race, on a designated racing circuit only.
- Not permissible for on-road or off-road public driving. (Like a Formula-1 car, etc).
Other
- License and registration must be carried on your person at all times.
- Specialized plates to fit a scooter should be developed and standardized across the EU which should be small enough that they do not completely ruin the appearance of the scooter, damage stability or create a hazard, and large enough for existing surveillance to read them and be mounted on the back of the scooter.
- If there is no license or registration, then the scooter must be seized by police and impounded indoors.
- All scooters must be manufactured under appropriate safety standards to protect the battery, must have overcharge protection, over-current protection and must have a balancing/ballasting circuit built into the battery and/or controller.
- Must come with original charger
- must be bought with an appropriate helmet and high-visibility vest (unless customer can prove they have one) and knee-pads must be sold with the scooter if it is more than Light.
- may only be purchased with ID showing a person intending to purchase is 18+
- Public must be made aware through the use of advertisement campaigns about these rules and regulations
- Public should be made aware of safe distances and urged to not overtake a scooter that is keeping pace with the rest of traffic as scooters need more space to come to a complete stop than a car or bike.
Reason
I believe the importance of these rules, and subsequently classifying these machines in the same category as a motorbike and requiring safety checks, limits and rules over where they can be driven and operated and on what surfaces will enable freedom, benefit the market and force accountability. It will remove reckless riders from the road, and force compliance with laws and positions on the road, while enabling safer driving, and enable scooters to be regulated and driven in a safer manner.
I have nearly 2 years riding experience under my belt. I started on a Xiaomai MI 2 Scooter, capping speed at 25kmh. Ive fallen into tram tracks may times in Dublin, lost traction because of small wheels and been run off the road by cyclists going twice as fast as me, and by cars not giving me any space. I upgraded to a Dualtron Mini (By Minimotors) which brought me to 45kmh. It was safer to merge into traffic, but I still got run off the road, and was hit by a car that didn't use its indicators or look towards me, just pulling out to do a U-turn in the middle of a busy road, writing off the scooter. I had a camera recording the incident and insurance found in my favor.
I have since moved onto a Minimotors Blade X (Taverun Blade X/Minimotors variant) and am comfortably able to keep up with traffic. since January 2022, to July 2022 I've been run off the road 3 times, and had 16 close calls. In the same time this year 2023 I've been run off the road 18 times, have had 30+ close calls with Taxis, Cyclists and busses. Ive been hit twice by drivers from behind not stopping while in traffic and (while on foot) Nearly hit by a bus, I feel unsafe getting on my scooter because of inattentive drivers and Taxi drivers stopping wherever they want, of people pulling out without any warning, and people not checking their mirrors or giving necessary space for things to be safe. The proposed rules in my petition will make it safer for me and everyone else, without rendering €3,000 of equipment illegal, while also giving me a framework to adhere to, to ride safely, and a place on the roads of Dublin, without having to worry about people thinking that their big metal boxes are superior to me, despite going at the same speed.
I hope that my Petition will pick up some steam, and that regulators in Europe will make educated choices, as so far, I have not been able to find any other scooter riders making any noise, and neither have I seen any member of government (in Ireland and Brussels) riding an electric scooter. My hope is that we get enough support to force governments across Europe to bring in inclusive laws for Scooters and fair regulation. I hope to see you backing this with me, and that together as European Citizens, we can influence change in the right direction.
