The petitioner complains that, notwithstanding the Bologna Plan, which is designed to ensure equal and comparable education and training in every EU Member State, all applications for recognition of medical qualifications obtained by Spanish nationals in Poland are being systematically rejected by the Spanish Health Ministry. According to the petitioner, this can be attributed to the additional requirements stipulated by the Spanish authorities over and above the minimum standards provided for under Directive 2005/36/EC. These additional requirements are laid down in Commission Delegated Decision (EU) 2019/608 of 16 January 2019, which requires all doctors who wish to practise in Poland, to successfully complete the national ‘LEK’ examination and a ‘staz podyplomowy’ postgraduate internship, in addition to obtaining their medical qualifications. The petitioner asks the EU to explain to the Spanish Ministries of Health and Education how Directive 2005/36/EC should be implemented by all the EU Member States. He is also seeking automatic recognition of qualifications without long delays and bureaucratic obstacles.
