Vlagatelj peticije trdi, da je Nemčija kršila pravo EU, ker ni izvajala zaščitne klavzule iz člena 8 Direktive 93/42/EGS o medicinskih pripomočkih in zaradi neupoštevanja kasnejših sodb Sodišča Evropske unije. Poziva k uvedbi kazenskega postopka zoper uslužbence, ki s svojim ravnanjem ali opustitvami kršijo pravo EU.
